A charge of Driving Under the Influence or Driving While Intoxicated can have a wide ranging negative impact on every aspect of your life. A conviction can result in a suspension of your ability to drive, a possible jail sentence, excessive fines, State surcharges, an increase or loss of insurance coverage as well as the imposition of an interlock device on your vehicle. The penalties become exponentially worse if this is your 2nd or subsequent offense. 1st conviction: –
- up to 30 days in jail
- fine ranging from $250-$500 (BAC dependent)
- loss of driving privileges up to 6 months
- installation of interlock device *
- New Jersey. State surcharge. of $1,000 a year for 3 yrs
- 12-48 hours of IDRC (carries a program fee $250+) The Intoxicated Driver Resource Center provides an educational and screening program for those convicted of alcohol related violations. This will also determine if further treatment is required.
2nd conviction:
- up to 3 months in jail
- fines ranging from $500 – $1,000
- Loss of driving privileges up to 2 years
- installation of interlock device *
- IDRC
- New Jersey State surcharge of $1,000 a year for three years
3rd conviction:
- up to 6 months in jail
- fine of $1,000
- installation of interlock device
- IDRC
- Loss of driving privileges for as long as 8 years
- New Jersey State surcharge of $1,500 a year for three years

*Effective December 1, 2019, ALL DWI AND REFUSAL CONVICTIONS must have an IID (Ignition Interlock Device) installed on ANY vehicle their own, lease or have access to. The vehicle will not start without a BAC less than .05%. You will not be able to restore your driving privileges until you have proof the IID was installed. Keep in mind, this also carries an installation fee, leasing fee monthly, and removal fee. Any tampering with the device or intoxicated reading can reinstate the original charge and bring you back to Court.
